Below are some of the most commonly asked Planning & Zoning questions:


Business License / Home Occupation

Q:  Can I run a business out of my home?

The zoning classification of your property determines whether a home occupation is a permitted use.  Please contact our office via email or by calling (434) 352-8183 to inquire on the zoning of your property.  A tax map number or an address will be required in order for us to look up this information for you.

Q:  Do I need a business license?

The County does not require a business license.  We do however require a Home Occupation Application to be completed and submitted for review.  

This application will help us to determine whether the occupation desired is permitted for the zoning district of your property.  The Home Occupation Application carries a fee of $25.00.

If the property in question is located within the Town limits, of either Pamplin or Appomattox, you must contact that office to inquire on requirements.

You may also want to contact the Clerk of Circuit Court's office to inquire on any regulations they may have on registering your business name.

Another thing to consider is if your business is providing a service to another person or company, a contractor's license may be required.  In which you would contact the Department of Occupational Regulation (DPOR).

Giving or Selling a Piece of your Property

Q:  I have "x" amount of land and would like to give my son / daughter a piece of it.  Can I?

Appomattox County consists of several different zoning districts.  Each district has different qualifications on dividing land.

Q:  I'm not dividing land, I'm just giving my son / daughter a piece of what I have.  Is giving the same as dividing?

Any time you take one parcel of land and make it into more than one, you are considered to be dividing land. When dividing land, a licensed land surveyor must be contacted in order to create a plat of the new boundary lines.

Q:  How much land do I need in order to build a house?

Appomattox County consists of several different zoning districts.  Each district has different qualifications on dividing land and setbacks from property lines and other structures.

Q:  What are setbacks?

The minimum distance by which any building or structure must be separated from a street right of way or lot line.

Q:  Can my son / daughter put a home beside mine?

This question is addressed by §19.6-18 of the County Code. 

Permitted / Conditional Uses

Q:  What can I do with this piece of land?

Each parcel of land is governed by a set of regulations.  There are state regulations regarding the use of land, as well as each piece having a comprehensive plan land use designation in addition to it having a zoning district classification.

Before purchasing a piece of property, we recommend visiting the Department of Community Development with your intentions for the property.  

We will help you determine the permitted uses and will assist you should you be in need of a conditional use permit.

Plat Review

Q:  I'm selling my home and the bank is telling me get a resurvey done.  What is this?

A resurvey consists of a licensed land surveyor performing a study of your land and preparing a plat showing the boundary lines of the property.  You should be provided a minimum of six (6) plats signed by the surveyor.  

These plats, along with a Plat Application, must be submitted to the Department of Community Development for review.   Upon the approval of the plat, they must be taken by you, or your agent, to the Clerk of Circuit Court's Office to be recorded.  This step is what makes the plat and official document of record.

Q:  Is there a fee for the Planning & Zoning Department to look at my plat?

Yes, there is.  A resurvey or a division of land with 1-4 lots is $25.00, plus $5.00 per lot.  When dividing a piece of land into more than 5 lots, the fee is $50.00, plus $10.00 per lot.

Setback Requirements

Q:  I'm going to build a house or a garage.  Can I put it wherever I want to on my property?

Yes, as long as you are within setback guidelines, which are different for each zoning district.  Please call our office or review the Zoning Code for setback requirements in your district.
